DZIQ: Comelec junks disqualification case vs Sulu gov


Citing lack of merit, the Commission on Elections junked the disqualification case filed by a local official against Sulu Governor Abdusakur Tan following the May 10 automated elections, Radyo Inquirer reported Thursday.

MANILA, Philippines – Citing lack of merit, the Commission on Elections junked the disqualification case filed by a local official against Sulu Governor Abdusakur Tan following the May 10 automated elections, Radyo Inquirer reported Thursday.

The poll body’s First Division issued the six-page resolution dismissing the case filed by Mayor Ahmad Nanoh who accused Tan of violating the Omnibus Election Code when he suspended the mayor whom he slapped with an administrative complaint for allegedly refusing to support the candidacy of the Sulu governor, the report said.

But Tan countered that the 90-day preventive suspension against Nanoh wasn’t punishment but was part of the normal process so that he would not influence the investigation, the report said.

He said that Nanoh’s suspension was in relation to the Anti-Graft Acts and not part of the prohibition under Section 261 of the Omnibus Election Code and that there was no need for him to seek the permission of the Comelec.
